The Truth About Medical Malpractice Insurance Costs

In its analysis of medical malpractice insurance premiums (the amounts paid by doctors and other health care providers for their professional malpractice insurance coverage), medical malpractice claims, insurance companies profits, and the impact of medical malpractice laws restricting victims rights throughout the United States, the Americans for Insurance Reform (AIR), which is a coalition of almost 100 consumer and public interest groups in the United States, found,  in part,  in its report dated July 22, 2009 that:

1. Medical malpractice insurance premiums were nearly the lowest in 30 years when adjusted for inflation.

2. Medical malpractice claims had dropped 45% since 2000, when adjusted for inflation.

3. Medical malpractice insurance companies have enjoyed higher profits than the rest of the property casualty insurance industry, all of which have been very profitable over the last five years .

4. The periodic jumps in medical malpractice insurance premiums are related to the economic cycles of the insurance industry and decreases in their investment income and are not related to medical malpractice claims.

5. There is no correlation between the enactment of restrictive tort reform laws and medical malpractice insurance rates.

Therefore, there is no economic justification to further restrict medical malpractice victims’ rights to just compensation for their losses, which would have almost no impact on the overall health care costs in the United States.
