Nineteen-year-old Alexee Trevizo, who has been charged with first-degree murder with the alternative of child abuse resulting in death and tampering with evidence, went to Artesia General Hospital on January 27, 2023 with complaints of severe back pain. She reportedly denied being pregnant when she arrived at the hospital but lab tests later determined that she was pregnant.
Trevizo allegedly locked herself in a hospital bathroom for an extended period of time after which a housekeeper found a large pool of blood on the floor of the bathroom, and the housekeeper noticed that the trash bag from the trashcan in the bathroom was heavier than expected. Nurses reportedly then found a baby in the trash, who was deceased. Trevizo reportedly told doctors that her baby was not breathing when he was born and she did not know what to do with the baby because he was not crying at birth. Investigators reported that Trevizo said she put the baby in the trash bag.
Investigators reportedly determined that the baby was born alive but died shortly after birth because he could not breathe once he was placed in the trash bag in the trashcan. An autopsy reportedly ruled on March 28 that the baby died as a result of homicide.
In August, the baby’s estate filed a New Mexico wrongful death lawsuit against the hospital, alleging that hospital staff missed several opportunities to intervene, violated hospital policies (including allowing Trevizo to go to the bathroom alone), and that the hospital failed to properly train its staff. The New Mexico wrongful death lawsuit reportedly also alleges that the hospital staff should have assumed that Trevizo was pregnant, given her age and her symptoms.
According to the lawsuit, Trevizo was given several medications, including morphine by IV for about an hour, before she was given a pregnancy test.
Trevizo reportedly stated at the hospital, “He had hair and, um, he was like purple-ish. He wasn’t bruised or nothing like that. He was purple, pink-like skin color … I’m sorry. It came out of me and I didn’t know what to do. I was scared.” A physician at the hospital reportedly stated, “She put the baby in the trash can and then another clean liner over the top of it. The baby is dead…She killed the kid. She had it in the bathroom is what happened and then whatever she did, I don’t know — she’s going to lie.”
Trevizo reportedly told a doctor that she never had sex despite the positive pregnancy test.
