In 2017, a 66-year-old man sought testosterone replacement therapy from NuMale Medical Center, which has facilities in multiple states, for fatigue and for help in losing weight. According to his subsequent New Mexico medical malpractice lawsuit, a physician’s assistant misdiagnosed him with erectile dysfunction (ED) and began treating him for the condition that he did not have. The man reportedly purchased a medical treatment plan that included testosterone pellet implants in his butt and injections into his penis that he would perform at home.

The man became concerned that his at-home penis injections were not working and therefore returned to the clinic where the physician’s assistant allegedly told him that he was not properly performing the injections, and demonstrated the proper injection method that left him with a medically-induced erection when he left the clinic, according to his lawsuit. HIs New Mexico medical malpractice lawyer stated, “This physician assistant injected the chemical into his penis because he couldn’t figure out how to do it, and he injected 75% more of the chemical and a stronger dose than he should have, and sent the patient home and said ‘Go show all your friends.’ This is what he said to a 66-year-old man.”

When the man’s erection failed to subside over the weekend, he returned to the clinic where the medical staff reportedly attempted unsuccessful painful methods to relieve his erection. The physician’s assistant reportedly told him to drive himself to the emergency room where he had emergency surgery but by then he had already suffered permanent injury. According to his New Mexico medical malpractice lawyer, “His penis is dead. It’s actually, what it is now is it is much smaller than what it was, and it’s just a lump of scar tissue that doesn’t work in any way, shape or form.”

The New Mexico medical malpractice jury awarded the man $412 million, which will be in excess of $550 million when interest is added to the verdict. His New Mexico medical malpractice lawyer stated after the verdict, “If someone’s trying to sell you something medically, take a step back, ask other health care providers, get second opinions and third opinions. If there’s advertisements saying something’s going to be a quick fix for a problem, don’t trust it. Don’t trust it.”
