On March 11, 2024, a Nevada nursing home negligence jury returned its verdict in an amount in excess of $2.6 million for a 66-year-old man who fell in a nursing home five times during the just over two-week period he was a resident of the defendant nursing home.
Kurtis Roberts was admitted to Silver Hills Health Care Center in Las Vegas, Nevada in October 2020 for rehabilitation following surgery on his brain to treat his Parkinson’s disease. The nursing home determined that Roberts was at high risk for falling upon his admission to the nursing home. Despite such designation, he repeatedly fell and suffered a fractured spine as a result of one of his falls, after which he was transferred to another nursing home facility: “Despite recognizing Kurtis as being a fall risk, experiencing impulsivity following brain surgery, and having difficulty walking, Silver Hills still allowed Kurtis to fall in its facility.”
The plaintiff’s nursing home negligence lawyer has vowed to seek that the verdict be excluded from Nevada’s $430,000 cap on noneconomic damages in medical malpractice claims, arguing that the claim was for ordinary negligence: “The rationale was that it doesn’t take medical judgment to know that if someone falls, you need to be doing something to prevent it. This is a case of common, ordinary negligence, and I think it may be one of the first of it’s kind to result in this type of verdict.”
