The 20-year-old plaintiff sought treatment from Dr. Hershcovitch in December 2020 for issues related to her nose, which she had broken as a child. The lawsuit reportedly alleges that after both doctors reviewed CT scans that Dr. Hershcovitch had ordered, Dr. Cohen falsely told the plaintiff that her CT scans indicated extensive sinus disease that would require her to have sinus surgery.
On January 11, 2021, Dr. Cohen with the assistance of Dr. Hershcovitch performed surgery on the plaintiff’s nose and the alleged unnecessary sinus surgery. The lawsuit alleges that Dr. Cohen reportedly recorded false statements in his operative notes, including that the plaintiff had undergone conservative therapy before having surgery.
The lawsuit further alleges that C/V ENT Surgical Group and Southern California Sinus Institute failed to properly supervise both Dr. Cohen and Dr. Hershcovitch and negligently credentialed them to perform surgery at their facility, and that West Hills Surgical Center (where the surgery took place) also had a duty to properly supervise and credential its surgeons and had the ability to review the patient’s CT scans before the doctors performed the sinus surgery.
The plaintiff’s medical malpractice attorneys stated shortly after filing the lawsuit, “We thoroughly reviewed [the plaintiff’s] medical history before filing her case, and believe she is entitled to relief for what amounts to unnecessary surgery that caused medical, emotional, and financial damage. Doctors have a strict duty to do no harm and act in the best interest of their patients. We are concerned that other patients may have been recommended unnecessary procedures by Dr. Cohen or Dr. Hershcovitch and seek to correct that potential harm.”
