Doctor Suspended For Failing To Pay Malpractice Settlement: A Florida internal medicine doctor who specialized in pulmonary disease and critical care medicine had his Florida medical license suspended for failing to pay a $70,000 medical malpractice wrongful death settlement.
The Underlying Medical Malpractice Case
On November 6, 2014, a woman who was 35 weeks pregnant arrived at the Coral Springs Medical Center where she was found to be suffering with high blood pressure, rapid weight gain, and swelling due to leakage of fluid from her blood vessels. She was monitored and treated for five days in the hospital during which her condition did not improve, leading to the decision to induce labor. The baby girl was delivered by Cesarean section delivery on November 11, 2014.
On November 15, 2014, the woman’s blood pressure remained high and she was experiencing chest pain and shortness of breath. She was transferred to the hospital’s critical care unit where she came under the care of the defendant doctor and another critical care specialist. Despite her condition worsening on November 15, 2014, the defendant decided against intubating the woman.
The subsequently filed Florida medical malpractice wrongful death lawsuit alleged that the defendant and others administered medications that further compromised the woman’s breathing and failed to timely intubate her. The wrongful death lawsuit also alleged that the defendant failed to respond to STAT calls which resulted in another doctor coming to the woman’s bedside to intubate her. The woman suffered cardiac arrest but was resuscitated. She was transferred to a higher level medical center for a higher level of care.
The woman suffered two more episodes of cardiac arrest due to pulmonary edema and severe respiratory distress. She died on November 16, 2014.
A Florida medical malpractice wrongful death lawsuit was filed on November 3, 2016. In December 2021, the parties were ordered to engage in settlement negotiations that resulted in the defendant agreeing on December 16, 2021 to settle the claims against him for $70,000. When the settlement proceeds were not timely paid, a motion to enforce the settlement was filed.
On July 22, 2022, the State of Florida Department of Health filed an Order of Emergency Suspension of License against the defendant, stating “On or about February 5, 2022, the Seventeenth Judicial Circuit in and for Broward County, Florida, a Final Judgment was filed in favor of the plaintiff in a medical malpractice civil suit against Dr. Robinson, which ordered him to pay the plaintiff a total of $70,000.00 … To date, Dr. Robinson has failed to remit the payment of the Final Judgment of the underlying medical malpractice case ordered by the court … Section 458.320(5)(g)2. mandates that the Department summarily suspend Dr. Robinson’s license to practice medicine … The license of Keith Jamal Robinson, M.D., license number ME 86367, is immediately suspended.”
