Contaminated Sandwich Caused Death: A lawsuit filed against a California nursing home on April 18, 2023 in the Superior Court of the State of California for the County of Santa Clara alleges, in part:
Richard Van Truong (“Decedent”) was an adult person and resident of San Jose, CA. He was born on February 2, 1950 in Vietnam and died on January 22, 2022, in Santa Clara, CA, at the age of 71.
On or around December 19, 2021, decedent was admitted to defendant VASONA CREEK HEALTHCARE CENTER for post-surgical recovery. On or around December 22, 2021, decedent ate a contaminated sandwich provided by defendant(s). He subsequently fell ill, presenting with gastro-intestinal symptomology late December 22, 2021 and into December 23, 2021. The morning of December 23, 2021, decedent suffered seizures. Defendants called plaintiff ERIC TRUONG but did not call paramedics.
Shortly thereafter, plaintiff CYN TRUONG arrived and witnessed her father vomiting, and experiencing severe seizures with bodily convulsions. The nurses attending to decedent argued with each other over how to position decedent’s body during the seizures. At that point, decedent bit his tongue and it began bleeding. A nurse attempted CPR and decedent went into cardiac arrest. Paramedics arrived at some point after this event, located a faint pulse, but decedent suffered a second cardiac arrest causing a paramedic to declare, “this one is a goner”. Decedent was transferred to Good Samaritan Hospital Emergency Room. Even though approximately twenty (20) minutes had passed from decedent’s second cardiac arrest, Emergency Room care providers were able to resuscitate decedent. However, it became un apparent decedent had suffered brain damage and he was placed on life support. Lab work at Good Samaritan Hospital showed decedent had E. Coll in his lungs. Decedent died on January 22, 2022.
Plaintiffs are further informed and believe that while a patient at Defendants’ hospital, as a result of neglect and abuse as alleged herein, Richard Truong developed sepsis and septic shock as a result of an infectious process which developed as a result of deplorable unsanitary conditions, and lack of care by Defendants’ employees and agents.
That by engaging in the conduct, neglect and abuse, as alleged herein, including but not limited to, the deliberate understaffing of the facility knowing the harm that resulted to other patients during the months immediately before, during, and after the care at issue here, and the profit scheme by which they underfunded and understaffed the facility with personnel adequately trained and qualified to recognize and appreciate Richard Truong’s worsening conditions during the provision of their custodial obligations to him and take appropriate action, despite the known risks to elder adults, including Richard Truong, Defendants’ employees’ and agents’ actions were malicious, oppressive and/or reckless.
