California Nursing Home Lawsuit Alleges Neglect Led To Resident’s Fall And Death

162017_132140396847214_292624_nA California nursing home negligence lawsuit filed on June 14, 2016 alleges that a California nursing home’s under-staffing and its neglect of a 74-year-old resident led to her fall in February 2016 while she was in her bathroom and her subsequent death one month later while being treated in a hospital.

The California nursing home neglect lawsuit alleges that the woman was assisted to her bathroom and placed on the toilet after which the nursing home employee left her alone on the toilet. After the woman completed her business, she waited patiently for someone to return to assist her from the bathroom. After waiting what seemed to her to be a reasonable period of time for someone to help her, she used the call device in the bathroom to call for assistance. Still, no one came to assist her from the toilet.

The woman then decided that she had to act on her own and she attempted to stand up to leave the bathroom. Unfortunately, she fell forward in the process of standing, striking her head and falling to the floor of the bathroom. She attempted to break her fall by extending her hands and in the process of doing so she fractured both of her wrists.

When the nursing home staff finally returned to the woman’s bathroom, a nursing home employee scolded the woman for standing up on her own and struck the woman on her head with a showerhead to stop her from crying, according to the California nursing home lawsuit. The woman was then placed back in her bed despite her obvious injuries and her emotional state.

The woman was ultimately transported to a local hospital where she was x-rayed and it was determined that she had suffered a brain injury due to her fall. The woman’s family allege that they first learned of the woman’s injuries and that she had been transported to the hospital when someone from the hospital called to advise them that the woman was in their care. The woman died as a result of her injuries on March 18, 2016.

The family’s California nursing home negligence complaint not only alleges neglect by the nursing home staff but also contends that the nursing home deliberately under-staffed the nursing home that put its profits over the well-being of its residents.
