On June 17, 2021, an Iowa nursng home neglect jury retuned its verdict against a North Iowa nursing home for the death of an 83-year-old resident in June 2017. The jury awarded the resident’s estate $2 million for pre-death pain and suffering, $1 million for pre-death loss of full mind and body, $1 million for loss of relationship, and $2 million in punitive damages.
The resident’s children filed their Iowa nursing home negligence wrongful death lawsuit in November 2017, alleging causes of action for wrongful death, negligence, breach of contract, dependent adult abuse, and loss of consortium. They alleged that the defendant Iowa nursing home failed to provide their mother with appropriate medical care and failed to prevent her from suffering falls or prevent other injuries from occurring. They further alleged negligent hiring, inadequate training of staff, and covering up adult abuse, neglect, and negligence.
In August 2019, another Iowa nursing home negligence wrongful death lawsuit was filed against the same nursing home, alleging that the resident was taken to the hospital on February 28, 2018. Before being transported to the hospial, she was crying, moaning, screaming, and bleating, but was only given a nonprescription pain reliever. The nursing home staff could not obtain a blood pressure reading or feel her pulse for almost three hours before requesting an ambulance to take her to the hospital. The resident may not have had water for several days before being sent to the hospital. The resident was returned to the nursing home the same day, where she died that day.
