On December 16, 2025, a Baltimore County Maryland jury returned its verdict in the amount of $1.85 million for a nursing home resident who suffered heat stroke due to being left outside in the heat for hours because the staff forget she was outside. The resident, who is in her 70s and suffers from dementia, told first responders and the hospital staff where she was brought, “I went outside to get some fresh air and I was yelling for hours for someone to let me in.” The jury’s award was entirely for noneconomic damages, which will be reduced to $965,000 due to Maryland’s cap on noneconomic damages in medical malpractice cases that was in effect in June 2024 (the date of the incident).

According to the Maryland nursing home negligence lawsuit, the staff brought the resident outside and then forgot about her for at least four hours. It was not until the nursing home staff realized that the resident was not within the facility at dinnertime that they discovered her in the courtyard, slumped over, covered in vomit, nearly unresponsive, and severely sunburned. The resident spent one and a half weeks in the hospital being treated for her injuries. She now resides in different assisted living facility.

The Maryland nursing home negligence lawsuit reportedly alleged, in part, “Had the Plaintiff and her family known that Morningside had a pattern of ignoring and failing to implement OHCQ corrective action plans, especially those addressing safety, medication management, and incident reporting for memory care residents, the Plaintiff would never have become a resident at Morningside.”
